Präambel

In Ergänzung und unter Beachtung des
§7 (6) der Satzung* beschließt der Vorstand des ISST e.V. am heutigen Tage für die Durchführung der Vorstandswahl folgende Wahlordnung:

Preamble

In addition to and in compliance with
Section 7 (6) of the Statute*, the ISST Executive Committee has decided today to implement the following Electoral Regulation for the Society’s bi-annual elections of the Executive Committee:

Artikel 1

(1)  Der Vorstand ernennt im Zuge seines Amtsantrittes schnellstmöglich ein Wahlkomitee. Aufgabe des Komitees ist die Durchführung und Überwachung der Vorstandswahl.

(2)  Das Komitee besteht aus mindestens zwei zertifizierten Vereinsmitgliedern; ein Mitglied wird für den Vorsitz ernannt. Das Komitee wird vom Vorstand für einen Zeitraum von zwei Jahren mit einfacher Mehrheit ernannt. Die Amtszeit soll parallel zu der des Vorstands verlaufen.

(3)  Kein Mitglied des Komitees darf für den Vorstand kandidieren oder dort stimmberechtigt sein oder ein übermäßiges eigenes Interesse an Vereinsangelegenheiten oder Satzungsänderungen haben, über die durch die Mitglieder abgestimmt werden soll.

Artikel 2

(1) Wahlberechtigte Mitglieder: Über die Wahlberechtigung entscheidet die Satzung. Der satzungsgemäße Status der

Wahlberechtigung muss eine Woche vor dem Aufruf zur Kandidatenbenennung vorliegen (lt. Artikel 2, (2) ). Mitglieder, die diesen Status danach erlangen, werden nicht an der Vorstandswahl beteiligt. Der Kreis der Wahlberechtigten ist auf der Website rechtzeitig anzukündigen.

(2)  Wiederwahl von Vorstandsmitgliedern: Der Präsident/die Präsidentin erfragen im Vorstand, welche/s Vorstandsmitglied(er) für eine Wiederwahl in ihrer derzeitigen Position zur Verfügung steht/stehen und teilt dies den wahlberechtigten Mitgliedern spätestens eine Woche vor dem Aufruf zu Kandidatenvorschlägen mit. Die Mitteilung beschränkt sich dabei auf die Nennung der Kandidaten.

(3)  Aufruf zu Kandidatenvorschlägen: Frühestens am 1. April eines jeden Wahljahres ruft das Wahlkomitee die stimmberechtigten Mitglieder per E-Mail oder über andere geeignete elektronische Mittel auf, Kandidaten für die Vorstandsämter vorzuschlagen. Jedes stimmberechtigte Mitglied kann für jede Position nur jeweils eine Person vorschlagen. Die Vorschläge können dem Wahlkomitee nur schriftlich per E-Mail eingereicht werden. Kandidatenvorschläge sind für die Vorschlagenden verbindlich und können nicht zurückgezogen werden. Ein Vorstandsmitglied, das zur Wiederwahl zur Verfügung steht, muss ebenfalls als Kandidat vorgeschlagen werden. Kandidaten können sich selbst vorschlagen. Das Wahlkommittee hat Stillschweigen über die eingereichten Vorschläge zu bewahren.


(4)  Dem Aufruf an die Mitglieder zur Benennung von Kandidaten ist eine ausführliche Beschreibung des gesamten Wahlvorgangs beizufügen.

(5)  Kandidatenliste: Drei Wochen nach Beginn des Aufrufs beendet das Komitee die Vorschlagsphase. Es prüft die Wählbarkeit der vorgeschlagenen Kandidaten und ermittelt, ob diese für das Amt zur Verfügung stehen. Es wird erwartet, dass vorgeschlagene Mitglieder, die ihre Kandidatur akzeptieren, im Fall ihrer Wahl für die Vorstandsposition zur Verfügung stehen. Das Komitee erstellt die endgültige Liste aller wählbaren, interessierten und zur Verfügung stehenden Kandidaten.

(6)  Aufruf zur Wahl: Das Komitee versendet innerhalb von 7 Tagen nach Beendigung der Vorschlagsphase die endgültige Liste der Nominierten an alle stimmberechtigten Mitglieder des Vereins und fordert zur Wahl auf. Die Kandiaten werden in alphabetischer Reihenfolge vorgestellt. Dem Aufruf ist eine ausführliche Erklärung über den Ablauf des Wahlvorgangs beizufügen.

(7)  Die Kandidaten können innerhalb einer Woche nach Ende der Vorschlagsphase persönliche Erklärungen für die Vorstellung auf der Website des ISST beim Wahlkommittee einreichen. Diese Erklärungen werden zeitgleich veröffentlicht und bleiben bis zum Ende der Wahl öffentlich. Eine eventuell vorhandene Mailingliste oder das Mitgliederforum der Website des Vereins dürfen zu keiner Zeit für Zwecke der persönlichen Kandidatenvorstellung benutzt werden. Zum Zwecke der Kandiatenvorstellung und
diskussion speziell eingerichtete Blogs und Foren sind davon ausgenommen.

Artikel 3

(1) Die Wahl findet im Zeitraum von 14 Tagen nach der Aufforderung zur Wahl statt.

(2)  Die Wahl kann über die Website oder in anderer geeigneter elektronischer Form abgehalten werden. Bei der Wahl des elektronischen Mediums muss gewährleistet sein, dass die Identität der abstimmenden Person zweifelsfrei festgestellt werden kann.

(3)  Die Wahl ist gültig, wenn mindestens ein Viertel der stimmberechtigten Mitglieder ihre Stimme abgegeben haben. Für jeden Nominierten wird die Anzahl der erhaltenen Stimmen festgestellt. Für jede Position schlägt die Kommission demjenigen Kandidaten das Amt vor, der die einfache Mehrheit der abgegebenen Stimmen erhalten hat.

(4)  Das Wahlkommittee prüft zeitgleich mit der Veröffentlichung der Ergebnisse, ob jeder gewählte Kandidat das Amt annimmt. Eine Bedenkzeit von 3 Tagen wird eingeräumt. Falls dem Wahlkommittee bis dahin kein positiver Bescheid vorliegt, gilt die Wahl als angenommen. Falls die Wahl abgelehnt wird, gilt der Kandidat mit der nächst höheren Anzahl von Stimmen als gewählt. Falls nur ein Kandidat angetreten ist und dieser die Wahl nicht annimmt, wird nur für diese Position ein neuer Wahldurchgang durchgeführt.

(5)  Falls kein Kandidat eine Mehrheit erzielt, erfolgt eine Stichwahl zwischen den beiden Kandidaten mit den meisten Stimmen pro Position. Die Stichwahl findet in einem Zeitraum von 14 Tagen statt. Artikel 2 Abs. 5 und Artikel 3 Abs. 2 und 3 dieser Wahlordnung gelten entsprechend. Im Falle einer Stimmengleichheit entscheidet das Los.

Artikel 4

(1)  Das Ergebnis der Wahl wird den Vereinsmitgliedern unmittelbar nach Auszählung der Stimmen auf der Website des ISST e.V. ohne schuldhafte Verzögerung bekannt gegeben. Eine zusätzliche Mitteilung über die aktuelle Mailingliste des Vereins ist möglich. Später abweichende Wahlergebnisse auf Grund von nachrückenden Gewählten werden auf gleichem Wege mitgeteilt.

(2)  Die Amtsperiode des neu gewählten Vorstands beginnt am 1. des darauffolgenden Monats. Der bisherige Vorstand bleibt bis zur Wahl eines neuen Vorstands im Amt.

(3)  Scheidet ein Vorstandsmitglied vorzeitig aus dem Amt aus, so bestimmt der Vorstand für den Rest der Amtszeit ein Ersatzmitglied.

Artikel 5

(1)  Sollten die in der Wahlordnung angeführten Zeitabstände und Fristen nicht eingehalten werden können, so ist der Vorstand ohne schuldhafte Verzögerung vom Wahlkomitee darüber zu informieren. Der Vorstand entscheidet in diesem Fall innerhalb von 72 Stunden über die Fortführung oder über den Abbruch des Wahlvorgangs. Bei Fortführung des Wahlvorgangs, sind die Fristen entsprechend zu verlängern.

(2)  Über die gesamte Tätigkeit des Wahlkomitees soll geeignet Protokoll geführt werden. Alle

Artikel 1

(1)  The Executive Committee (EC) will appoint an Election Committee as soon as possible after their term of office begins. The Committee's task is the implementation and monitoring of the EC election.

(2)  The Committee is comprised of a minimum of two certified association members, one of them is appointed as chair. The EC will appoint the Committee for a period of two years by a simple majority. The term of office shall run parallel to that of the EC.

(3)  No Committee member may run for the EC or be eligible to vote or have an excessive self-interest in society matters or amendments that are to be voted on by the members, which is deemed to be a conflict of interest.

Article 2

(1) Members eligible for voting: The Statute stipulates the eligibility to vote. The status of the voters’eligibility under the Statute must be available one week before the call for nominations (see Article 2,(2) ). Members who qualify for voting thereafter are not eligible to vote in the election on the Executive Committee. The members eligible to vote are to be announced on the website in due time.

(2) Re-election of Executive Committee members: The President will find out which members of the current EC would like to run for re-election to their current position and report this to the membership at least one week before the call for nominations. The respective notice shall be limited to the names of the candidates.

(3) Call for nominations: The Election Committee will contact all eligible voting members no earlier than 1 April of each election year by e-mail or other suitable electronic means to propose candidates for the EC offices. Each eligible voting member may propose only one individual for each EC position. Proposals may be submitted to the Election Committee in writing via e-mail only. The proposals for candidates submitted by the proposing members are binding and may not be withdrawn. Each member of the EC who would like to run for re- election must also be proposed as candidate. Candidates may propose themselves. The Election Committee must maintain silence about the submitted proposals.

(4) A detailed declaration outlining the electoral process will be included with the call for nominations.

(5)  List of nominees: After three weeks the Committee will close the nomination phase. The Committee will review the eligibility of all nominated candidates and determine whether they are available for and interested in the position. Individuals who accept their candidacy are expected to abide by the results of the election and, if voted into office, accept their position. The Election Committee will prepare a final list of all eligible, available and interested nominees
.

(6)  Call to vote: The Committee will send the final list of nominees to all eligible voting members of the Society seven days after the proposal phase has ended, with detailed instructions about the voting procedure. The candidates should be listed in alphabetical order.

(7)  The nominees may submit personal statements to the Election Committee to be posted at the ISST website for presentation within one week after the end of the proposal phase. All statements will be published at the same time and will be publicly available until the end of the election. The S
ociety’s mailing list, if any, or the member’s forum on the Society’s website shall at no time be used for such statements. This does not affect blogs or forums set up particularly for purposes of presenting or discussing candidates.

Article 3

(1) The election will take place within 14 days after the call to vote.

(2) Voting may take place through the website or other appropriate electronic means. When choosing the electronic means, it must be ensured that the voter's identity can be established beyond doubt.

(3)  The election is valid if at least one quarter of the members eligible to vote did in fact cast their vote. The number of votes received will be determined for each nominee. The Committee will offer the office for each position to such candidate who was elected by simple majority of the votes cast.

(4)  When publishing the results, the Election Committee simultaneously verifies whether the elected candidate assumes office. The candidate is granted a period of 3 days for consideration. Acceptance of the election is implied if the Committee does not receive a positive decision in this time. If the candidate with the most votes is unable to accept the position at the conclusion of the election, the candidate with the next highest score will be elected to that position. If there has been only one candidate running for said position, the election procedure will be repeated for said position only.

(5)  If no candidate achieves a majority, a runoff election between the two candidates with the most votes per position will be held. The runoff election will take place within a period of 14 days. Article 2 (5) and Article 3 (2) of this Electoral Regulation shall apply accordingly. Adrawing of lots will decide in the event of a tie vote.

Article 4

(1)  The election results will be announced to the association members via the ISST website with no undue delay after the votes have been counted. The results may additionally also be announced via
the Society’s current mailing list. Updates to the election results due to individuals deciding to withdraw their candidacy will be announced in the same way.

(2)  The term of office of the newly elected EC begins on the first of the following month. The previous EC will remain in office until the election of a new EC takes place.

(3)  The EC will designate a substitute member for the remainder of the term if an EC member resigns from office prematurely.


Article 5


(1)  The Election Committee shall notify the EC with no undue delay if the time intervals and periods listed in the Electoral Regulations cannot be met. In this case, the EC shall decide whether to continue or terminate the electoral process within a period of 72 hours. The deadlines for the remaining phases of the electoral process shall be extended accordingly.

(2)  The minutes on the overall activities of the Election Committee shall be recorded accordingly. All election relevant data shall be recorded in a legally admissible manner for a period of 10 years.

(3) The election results will be summarized in a protocol which has to be signed by the EC according to the Statute.

Vorstandswahlen: Der Vorstand wird für 2 Jahre gewählt. Zum Vorstand kann nur gewählt werden, wer ordentliches Mitglied ist und über eine Zertifizierung des ISST e.V. verfügt. Nur ordentliche Mitglieder des Vereins besitzen ein Stimmrecht für Wahlen zum Vorstand. Jedes stimmberechtigte Mitglied hat eine Stimme.

Wahlen zum Vorstand erfolgen mittels elektronischer Abstimmung. Ziel der elektronischen Abstimmung ist es, möglichst vielen Mitgliedern die Teilnahme an der Vorstandswahl zu ermöglichen, ohne dass eine physische Anwesenheit bei einer Mitgliederversammlung erforderlich ist. Eine Vorstandswahl in einer Mitgliederversammlung ist ausgeschlossen. Näheres regelt eine Wahlordnung.

Election of the Committee: Executive Committee members will serve for a 2 year term. Only full members certified by ISST e.V. can be elected to the Committee. Only full members are eligible to vote in the election of the Executive Committee. Each eligible member has one vote.

Executive Committee elections will be done via electronic voting. It is the goal of electronic voting to allow as many ISST members as possible to participate in the elections of the Executive Committee without having to be physically present in a membership assembly. The Executive Committee cannot be elected in the Membership Assembly. Further details are outlined in election regulations.
